Yes, only in Melbourne Beach could all this happen. Does anyone have a plan to save this Town? I offered a plan when I applied for Interim Town Manager. I was the politically incorrect candidate, possibly associated with 'persons in question'.
Ok, here is a plan for fixing MB. Just keep it simple. Get rid of the controversy, we know what I’m talking about, or should I say who I’m talking about. Then ditch the clerk, we all know she can be had, bought, duped or whatever her excuse for breaking the law is. Finally, impeach all of your counsel members and have YOUR community vote the right people in. This time do your homework and find out about the people you vote for. Like the candidates who apply for the PD, interview the neighbors, friends, relatives and check their credit. Credit tells about someone’s character. I’m not talking about a guy who goes through a divorce and gets screwed by a bitch wife or a woman whose spouse dies and she’s left with one income and a few children. Those fall under the title of special circumstances. Set up a community committee or do your own homework find out about anyone who wants to come into YOUR town to work. You guys have been up to your asses in problems for years, you’re an easy target for people who get booted out of another town and come to yours and end up making your lives hell. At least the people who are proactive won’t be the ones sitting around with the wool pulled down over their eyes, (Susan.) Speaking of Sad Sue, where has she been? Not hearing too much if anything from her. Guess she found out what a bunch of idiots she was backing. Its ok we’ve all been there. OK, not me but hey what the hell, it could have happened. Since the Town has shown that it does not, will not follow the police manual, I say we throw it out and start over. No cop should ever have to be suspended, no matter what the crime with the standard that has now been set.
You asked if I would have allowed the Chief to continue working.
While FDLE was doing their investigation, it was probably sensible to allow him to maintain his position. Remember that during that period, FDLE was looking at alleged charges of misconduct. Alleged is the operative word in that sentence. Once FDLE passed their findings to the State Attorney, I think it was time for the Chief to be suspended with pay. FDLE must have believed there was enough evidence to warrant prosecution; they wouldn't waste the SA's time if they didn't believe
there was a strong possibility of guilt.
It seems very strange the Town Commission will not recognize what is happening here. The interim manager is not in a very good position to take action unilaterally. But after consulting the interim Town Attorney and establishing his position, he should publicly make the recommendation to the Commission, placing it as an agenda item, and forcing the Commission to take action. It would be wrong to simply fire the Chief. What if for some reason the SA can't create a case? The Town would be in severe jeopardy of a serious lawsuit. That's why suspension with pay is the proper procedure. You can't act on emotion in these situations. A mistep or mistake now can be very costly later. Suspension with pay does not imply guilt but gives the Town protection.
The Town has placed itself in a somewhat vulnerable position currently. If the Chief is found guilty by a court at a later date after having being allowed to work during a period of time while it was known that he might be found culpable, any actions he took during that time could be questioned. Suppose he decided to fire an officer. That officer might come back to the Town and argue that the Commission knowingly allowed a Chief to direct Town business while there was evidence that he might be unsuitable in his position of authority. I wouldn't want to be a Commissioner with that sword hanging above my head.
Son of a Gun, you said it all very well. As for suspension with pay, OK I would have to agree, I personally would like to see him fired but as you say, that's emotion talking and rightly so for what he did to this woman and the badge he wears.

Son of a gun, I agree about the personal and accept your key word alleged, but carry it all on one more step. In and during FDLE's investigation, any lie told to FDLE could have been reported immediately to Standards and Training or any lie given the Town at any time could have been reported to Standards and Training. There never has been any hesitation by Davie to send anything he could to those who have the power to remove certification. Are we now seeing a flaw in our system or are we watching an interim manager with not enough guts to ask an independent agency to do an investigation? The complaint sent by the ex-wife was not the only complaint. There have been other complaints sent to the Town and the Town has delayed looking into the complaints with the idea that they must wait for FDLE to finish their work first. I personally find this was a mistake.
I also agree with the liability presently placed on the Town and in it's future. In the end, MelBeach may just gain some hindsight and realize his suspension with pay would have been much cheaper.

I would say that an ethics committee would be a great idea for the purpose of suspending David Syrkus pending the outcome of the investigation. That wouldn't take up too much time or resources. It would be pretty quick after they see the evidence compiled against the soon to be defendant.

If Davie, our Aprils Fool, really, really thought that DD had impersonated a police officer, and filed a complaint with FDLE, how is it the details of said complaint were told all over Town?
What happen to the "keeping quiet" about complaints filed until after investigation? Can we not expect "closed mouth," even from the head of a police department?
I know there is said complaint because a copy was requested and FDLE stated it was too close to the criminal investigation of Davie to make it public record.
Even Channel 9 reported that Davie said he had filed a complaint against the person who uncovered the evidence. Now we hear details as to how he posed as an officer.
The more I hear about this complaint, the more I feel the Perjury charge is multiple lies told during investigation.

You all can say whatever you want about Walters but from what I know of the man he is a no nonsense guy and doesn't bs around. You know exactly where you stand with him. As it should be, he doesn't take kindly to being stabbed in the back which we all know is happening quit frequently around MB. I think I can say with all certainty that if you put him back as the cheif, interim, let him clean up the department and then clean up your council and then put him back on the council then you stand half a chance of a better town government. I know this may be a little confusing to some and I hope Walters doesn't mind hopping around a bit but he is your best chance at repairing the damage that has been done. To the people who don't like Walters, get over it, you guys are so screwed up there and not one of you are trying to fix it. Maybe you don't know how or maybe your groupies for some of the so-called commissioners who have no business in politics AT ALL bottom line, drastic measures for drastic times. You can expect charges soon, they can't take too much longer since they have all of the evidence. Unless they found other stuff we missed. Syrkus talked about the investigation to town folk about the trumped up allegations he TRIED to nail DD with. Syrkus never could keep his big fat mouth shut about anything. He thinks he's impressing people with his "in the know" attitude. He's like that you know.

Some of the interested parties actually had to go and get the evidence for the authorities because, I don't really know why but they were aware of what was going on but the evidence was compiled by the citizens. As for the other blog, can't help you there, the person who owns that blog isn't really a friend over here, he would rather throw insults than to really talk about the issue. I'd rather not comment on prior experience since I'd like to remain 'unknown'.
However, I'll say that MB had their chance when I was willing to take the risk of leaving my current employment to become the interim manager with no guarantee for the permanent position. I like my job very much but saw MB as the ultimate challenge and I thrive on dealing with adversity. I'm also good at evaluating risk and there will be plenty of that for who ever is willing to serve. I also thought of all the good people who would be disappointed if I left my current responsibility and the difficulties they might face with my departure. I'm very good at what I do and I'm well respected, though this doesn't translate to a big paycheck! So, in the end I decided the risks probably outweigh the small increase in income and felt it best not to pursue the position. Still, I am sorry to miss out on the opportunity to face the ultimate management challenge!

Do you remember when you were a kid and you were in trouble when your dad got home from work? Remember that feeling you had to deal with all day? I wonder if david feels that way only on a grander scale? I hope so.
Personally, I don't believe there is a need for an 'ethics committee'.
There should be policies and procedures defined in the department-government manuals that describe codes of conduct. When those codes are breached, the department head or Commission should take appropriate action. If the Town does not have these policies in place, this needs to be done. There are hundreds of municipal ethics code standards to use as models for Mel Beach. I don't know of any Brevard County city that has an 'ethics committee'.
There are ad-hoc committees that work on developing policies and standards and such a committee may be needed temporarily in Mel Beach. What you should not do is convene a group of neighbors to pass judgement. You're supposed to have hired and elected leaders who are competent in their job and act as necessary. If they believe an issue is 'over their head' there are FL state agencies to provide guidance or that will take the appropriate action.
If you create an ethics committee, you set the stage for some very nasty
possibilities that threaten stability. It would need to meet in the Sunshine, draw endless controversy and add to the mess that already exists.

Six to seven months ago, problems within the towns staff were brought to the attention of the Commission. This seems to be a lengthy amount of time for someone, either staff or Commission to step up to bat.
We have heard that different people are talking to "legal" yet here we are waiting on another agency to do "something".

Can someone post the details of the personel manual as it pertains to the Chief's duties and salary. I can't put my finger on my copy at the moment.
I have recently heard around Town that he is adding up hours for comp time, even those hours in which he attends meetings (with or without the request of the Commission).
Has anyone else heard about these matters and does his position allow him to write up any type of hours he wants?
Some of the people feel he is a salaried employee with no comp time.

Just wanted to be the first to let you know poor paul will not be running for office this year. Just about finished my own Miami military bankrupt investigation. Can someone explain why Melbourne Beach has so few people willing to offer competent leadership on the Commission? Many of the most successful, wealthy, educated residents of this County live in the Mel Beach. Attorneys, doctors and people of prestigious careers and none are willing to step forward to save their Town? WHY?!?
These are people who have accepted challenge and adversity throughout their lives and have reached the uppermost levels. Why are they so unwilling to accept a new challenge, to correct the mess that exists. They are experts in dealing with the most difficult troubles. Troubles now exist in their own backyard and they won't step forward and use their talents to benefit the place where they live.
Personally, the seeds of volunteerism were planted when I was very young and learned the history of my Town during the Revolutionary War. I was impressed to learn that British soldiers were
attacked by colonial residents as they marched the road in front of my home on their way to attack General Washington's supply depot. As a kid, I wondered if there was anything that might happen in my life that would require that measure of dedication to a cause.
Where are the residents of Melbourne Beach when their Town needs them so badly? Of course the job will be as difficult as some have ever faced. The reward of success will be self gratification; the knowledge that you've made an important contribution. Somebody who is a leader, gather your neighbors and take a stand and ask your fellow residents to support a new way of conducting the Town's business. Really folks, it's time to save yourselves. How long can you go on suffering this misery?

I understand the majority seeing this as a problem for MB, but try to widen the scope and see it as a problem for the County and State.
Regardless of the written or unwritten rules or laws, no one should be looking at the present situation and looking forward to it happening again here or anywhere else.
Something needs to be done now, using this example, to promote change for all. Maybe this means contacting FDLE, the Attorney General, our Govenor, State Representative, or Senators.
Maybe the power of the Florida Chief's Association could put something into place that would disallow a Chief holding a Town "hostage" while under criminal investigation.

Lacey, that rumor has circulated several times. I know several people who feel for certain it is true.
It is something that our blog has stated on many occasions that she should do. Too bad she was so stupid as to notarize anything for him in the first place. Having been issued a notary seal thru the GOV.'s Office should not be taken so litely.
Has there been any talk about what the Notary Commission is going to do to her after the felony investigation is through? Then you have to remember that letter she got from the notary insurance company. She still has a long battle yet, and it looks up hill all the way.
It seems the NNA is doing an article on Ms Burke in the May issue so maybe that'll tell us what we can expect or what the law says about what she did. I know she's banking on the fact that it's been 5 years, statute of limitation and so forth but what I think was mentioned was the fact that when the crime was discovered one more year was alotted to do something about it. I don't think I am wrong here, I spoke to my legal dept about this and this is what they said. So the fact that she is talking to the authorities and not saying, "talk to my attorney" says that she was offered a deal and that she is still open for prosicution. Otherwise, why would she talk at all, we all know she's just as egotistical as her buddy and partner in crime, davie boy. We'll see. When the NNA article comes out I will post it on here for all to see.

Golfboy; it looks to me like this citizen (DD) has put more time into solving this problem than anyone else, including the commission, has put into any of the problems your town has with the above issues. Why should he handle the above issues on his own like he's been handleing the Syrkus issue? How about giving the guy some help? No one else seems to want to do anything but him. If you have been at any of the town meetings you would have to admit that going in front of the commission is a farce. Furthermore, don't think that this is the only bad thing this pathetic excuse of a chief has done wrong. He's done plenty wrong, just never got caught. This was his perverbial straw that broke the camels back. I personally have no reason other than he's hurt a lot of people I care about and you just don't do that to anyone I care about. There is right and there is wrong. This guy is as wrong as he can be and no one up until now has been able to get anything done about him. Hey Golfboy, I just read your post and left it there for the others to read and to decide whether or not to delete you. I did want to comment on your comments. No, your wrong about the identity of DickTracey. In fact, you couldn't be more wrong than if you said it was your own mother. I will also say that you were pretty rude on top of it all. Your anatomy comment was uncalled for as well. My question to you is, why are you so combative? What's your stake in all of this. YOU seem to be taking things personally if anyone is. OH, that comment about my spelling, I type pretty fast, have long nails and am in a hurry most of the time and usually spell correctly but when you correct someone try not to make the same mistake when your doing so. It was kind of funny though that you corrected me and mispelled a few yourself.
In closing, stop trying so hard to piss everyone off. If you need to do something like that to entertain yourself then go throw eggs at Davie Boy's house. Now that would be fun!

made an attempt at (as she called it) LAW. She, for some reason, sees Davie as the "ultimate decision maker". Makes you wonder how many donuts he fed her.
We all know that the Town has a personel manual and a manager. I haven't seen anything that says Davie is the manager yet.
Then she went on to lie about DD and we don't need any more of her imaginary stories.

What did Hector aka Sad Sue have to say? What is she not right about? If I were sad sue I would shut the heck up before she gets in more trouble.
Here's the thing, she is confusing the truth with OPINION. This is why I said she wouldn't know the truth if it bit her in the ass. She wants to interject her dumb self in a conversation that she already got her butt kicked in once and now she's back as Hector to try again. Even a child learns the first time when they get their hand slapped not to do it again. Isn't she getting enough attention from that fiasco with the FALSE complaint she filed? And what's with the "Hector" name? Is she having an identity crisis on top of all the other crap she has bestowed upon herself? I don’t even know how she puts her shoes on the correct feet in the morning.
