I see that he did not turn himself in and had that fancy pants lawyer beg for him to be released on his own recognicense. Two words come to mind....FLIGHT RISK...He owns propertyt in the carolinas and will be gone overnight. Anyhow another reason may be that his son and his friends don't want dad ruining their jail gig....What ya'll think?
I think the judge and the lawyer should re-evaluate what they just did.

I too am wondering why burke wasn't arrested but again, rumor has it that she has turned states evidence against her boyfriend. If this is true then wouldn't it stand to reason that there was criminal intent when this whole ordeal took place. Otherwise, why would there be the opportunity for Burke to help the prosecution? She has no notary seal anymore so she really is useless as a city clerk. She can't notarize, she can't keep the website updated, she can't seem to get the document prices right which is why she charged dd so much for the "jerkus" file. Now that the "Butthead" is gone, when will they fire "Beavis?" She is just as responsible for the upcoming lawsuits getting ready to hit the little town of MB. And it's MB's counsel members fault. They were provided with the evidence against Pat and her boyfriend but they chose to do nothing so they will pay. Let's see if they have the brains to get rid of thier other liability. I doubt it.

Chief to learn fate during hearing
Police officer may lose job

Suspended Melbourne Beach Police Chief David Syrkus could find out this week whether he will be suspended without pay or possibly lose his job after he was charged with two felonies Thursday.
Interim Town Manager James Bursick said Syrkus was placed on administrative leave with pay pending a hearing, which is tentatively scheduled for Wednesday. He has been relieved of all duties until the meeting.

I agree with you about checking your property online often. People like Syrkus and the guy you speak of have the biggest cahunas to do something like that. It's done a lot from what I understand. Our Seniors who have a live in aid should watch or their children should do a check as well because it happened to a family member of mine about 8 years ago. My GreatUncle was in his 90's and his "caretaker" LOL, took care of him alright. After he passed the relative who was supposed to get the condo and the money in the bank was quit surprised to find out that this woman and her attorney son took everything he had. Scum suckers! Children should watch their senior parents affairs to make sure it's not happening to them.

Grand jury said no one should believe him and the SA is dropping all criminal cases that hinge on statements by him. The controversy that he and others started has rocked the Flagler County Sheriff's Office.

Here's the thing, if david doesn't LOOSE his job tonight then all "interested" MB citizens should start asking questions like, gee guys, what did he have on you that your not firing him. I believe the job these men hold is not an easy one in that you can't please all of the people all of the time. Therefore, tough decisions have to be made even though not all are going to agree. However, when one entrusted to make those unpopular decisions has to go through ridicule by those not in agreement that's when the job gets hard. Walters for instance, has been the center of ridicule many times so wouldn't it stand to reason that after so many years of making the tough decisions for his town and being the center of that ridicule he would take that personally? As far as his pension, I would have to say he deserves every penny of it for many years of service to his community. I suppose he could retire and have a nice life but he is still working, go figure. If it were me, I'd be on the golf course or cruising somewhere. I'm giving the man a break.
As for Donnie Price, he has certainly been the recipient of his share of ridicule but as I said, that's part of the job he chose to take on. I don't know the man personally, never met him but the way he has handled himself in the town meetings, i.e., letting people heckle the person speaking made him a little suspect. I think that's what made people wonder about him. This whole thing with Syrkus has divided the town as a whole because he wasn't put on administrative leave which is protocol. Nothing about his arrest was according to procedure which again makes people wonder what the heck is going on. The officer who was caught in a rather compromising situation was asked by David Surkus to resign for the good of the department while he himself did something 10 times worse and wasn't asked to leave by the powers that be. Makes ya wonder what the world is going on over there. Evidence was furnished to Price and the rest but again, nothing was done. Think of all the money that was saved for MB because a few of us conducted the investigation ourselves so that it would get done.
What about Pat Burke? She is a principle to the crimes that were committed yet, she is still employed by MB. She produced a letter from Mitch Needleman stating she can still notorize docs. WRONG! She cannot notorize any form of documentation because her license is on hold. If she does notorize anything then that "anything" will be null and void thus possibly causing some big problems for folks or the town. Why Mitch gave her that letter I don't know but he shouldn't have and the towns council should take the time to really find out but they won't, they would rather be handed the evidence which in this case they were and still did nothing to fix the Pat Burke situation. That pisses people off that know she also broke the law, Knowingly, but she is still there.
Can you understand the frustration people are feeling knowing damned well that if they themselves were to break the law what would happen to them? I'm sure you do.
Furthermore, why aren't the people of MB demanding that Pat be suspended pending the outcome of her investigation? Only a few of the MB folks including DD had the nerve to stand up at the town meetings to demand something be done with them. why is that? To make matters worse, they were heckled. Were you there the night Syrkus had Tibby Parker go into one of the town meetings to blow her trumpet about him? You're not hearing anything from her anymore are you? Why is thar? I'll tell you why, she too recieved the evidence and that shut even her up about how wonderful this Crook is.
Bottom Line, we live in a country with rules, laws, and a common way to do things. When people bend the rules to protect people like Pat Burke, David Surkus, and K. Syrkus then the rules or laws have been compromised and must be compromised for all. That's just basic, we learned that in kindergarten. You break the rules you have to be made to take responsibility. What responsibility is david Syrkus taking? None what-so-ever. He made the remark that DD and DSJ are out to get him and if he gets fired he'll be a rich man. What the hell is he talking about? He wouldn't have a case first of all. The evidence speaks for itself. The victim in all of this speaks for herself. That is what I call a serious character flaw that David comes equipt with. He has deluded himself into thinking he is above the law because he's done so many things against people and gotten away with it so in his words, "I've been through worse and got through that so I'll get through this." That is why all of the Chiefs and others in law enforcement are so pissed off at him. He will never take responsibility for his actions. Unless of course, he is getting good publicity, then it's all him nevermind the officers who actually did the job.

There is nothing wrong in not seeing "eye to eye". The problem starts when Commissioners can't agree that they disagree and get on personal agendas. Just like your not agreeing with this blog and sending vulgarity.
The top cop slammed on this blog has left a trail of dishonesty that some picked up on and you seem to say that this has caused you problems, therefore you go after the messengers. Too bad, you sometimes sound as if you might have information to close this case quicker, but fall back to name calling instead.
This blog did not form for the sake of cleaning house for MelBeach as for Commissioners or Mayor. It was started to show the illegle acts of a dirty cop and the two women who helped him accomplish that goal. As a matter of record, another blog started first and had many posts "Hail to the Chief" with comments as to his wonderful record. Commenters on this blog were not posted when they attempted to tell the truth about this chief, therefore going elsewhere to comment.
My suggestion to you would be to start your own blog if all you want to do is show the differences of Commissioners. Ask the Town for a spot on the Towns web site where citizens can comment on meetings and such. Certainly, at this time, the web site is not being kept up to date as it should be. The clerk is not doing her job, why do you think she gets away with it?

You on the other hand are just saying he is a good man. How about an example to justify your stand. The guy sure isn't very good at conducting himself during meetings open to the public so I'm not sure what your talking about when you defend him. You certainly have a right to your opinion and at the same time so does everyone else. So far you are the only one on here that sticks up for Price. Can EVERYBODY be wrong about him? I don't think so.

If memory serves me correctly, isn't Price the one who vigorously stuck up for Syrkus and made that really stupid remark, well he didn't commit the crime while he was our chief? Wouldn’t that have been some kind of admission that he understood full well a crime had been committed? If he is that dumb to know his boy committed this crime and not rally (for the good of the town he agreed to serve) to get him off the job then he also needs to find somewhere else to act like a big shot. Just a suggestion: Make it impossible for notary publics (as we know them today) to notarize Quit Claims unless they are party to a property closing, at which time, all parties would have to attend.

At the closing of the property, if it isn't closed at a title company, the mortgage broker handling the transaction/closing, for the buyer should provide the notory (also known as a signing agent). Not for the seller but the buyer and this signing agent/notary will wittness all signatures. In the case of the Quit Claim, unfortunatly there is no standard for who provides the notary. Unfortunatly, that's how David was able to pull it off. He said the Realtor handled the QC, Bull Bull Bull! Think about it, did the Realtor know Patty, did the realtor come all the way up here and get everyone to sign? David was using semantics. All the Realtor, if there was one, did was provided him via mail the QC to have signed and notorized. That's why ahole is saying "my realtor handled it."
While the theory above may be correct I am thinking that they could have, and normally do, have the QC signed at closing. Does anyone wonder, if david found the ex to cover up his crime then why didn't he find her to avoid stealing all that money in the first place.

(5) A notary public may not notarize a signature on a document unless he or she personally knows, or has satisfactory evidence, that the person whose signature is to be notarized is the individual who is described in and who is executing the instrument. A notary public shall certify in the certificate of acknowledgment or jurat the type of identification, either based on personal knowledge or other form of identification, upon which the notary public is relying.
(a) For purposes of this subsection, "personally knows" means having an acquaintance, derived from association with the individual, which establishes the individual's identity with at least a reasonable certainty.

b) For the purposes of this subsection, "satisfactory evidence" means the absence of any information, evidence, or other circumstances which would lead a reasonable person to believe that the person whose signature is to be notarized is not the person he or she claims to be and any one of the following:
1. The sworn written statement of one credible witness personally known to the notary public or the sworn written statement of two credible witnesses whose identities are proven to the notary public upon the presentation of satisfactory evidence that each of the following is true:
a. That the person whose signature is to be notarized is the person named in the document;
b. That the person whose signature is to be notarized is personally known to the witnesses;
c. That it is the reasonable belief of the witnesses that the circumstances of the person whose signature is to be notarized are such that it would be very difficult or impossible for that person to obtain another acceptable form of identification;
d. That it is the reasonable belief of the witnesses that the person whose signature is to be notarized does not possess any of the identification documents specified in subparagraph 2.; and
e. That the witnesses do not have a financial interest in nor are parties to the underlying transaction;

MB has the most pathetic city councel members of any town in Brevard, they know what their 2 employees did yet they continue to stick their heads in the sand and allow the idiot burke to continue working. I talked with someone from TMV last week. The stories on Burke are really funny. It is told that for over 6 months the finance committee could not get a finance statement from her. Her defense was bad software.....haha

I saw it on channel 9 at 6 that dsvid syrkus is going in tomorrow to "try to keep his paycheck." So I too am LMAO! How could he possibly justify MB paying him while he goes through a trial?????????
If his lawyer pulls this one off then dammit I am definatly using him when I start quit claiming peoples property out from under them. If Landman can manipulate the law to the extent that dufas gets to keep his paycheck, without earning it mind you, then I think I'm good to go. Hell, I won't even have to turn myself in to be fingerprinted or processed like a common crook is supposed to.
