Syrcus didn't catch me at anything and didn't embarrass me either. He did gross me out when he actually thought that I would go out with him, AS IF. OK, maybe that was a little embarrassing, and he was with this present wife. So give us a freaking break with your bull crap. I can assure you what's being said here is the truth. You don't have to believe anything here, no one is asking you to and no one gives a damned if you do or don't. What do you know about this guy? First of all you can't know too much if your still sticking up for the idiot. And as far as the name calling, well he's everything we say plus some. However, quit a few people took time out of their busy schedule to contribute to this investigation because for some reason the agency that should have done their job either wouldn't or couldn't. Syrcus should never have become a police officer much less a chief. Further, the truth will never be over shadowed by name calling. The truth is the truth no matter how it's delivered. People, Let me put a little perspective into this issue.
True Story:
There is a women raising a beautiful 17 yr old daughter. Both of them having a very sweet and quite demeanor. This woman lives in a very rural area in SC. They live in a single wide mobile home, chop wood for heat. You can actually see the wood under what was supposed to be a vinyl floor but it's so worn you can see the wood separating them from the ground outside. This woman doesn't have a car that runs so she has to depend on others to take her to the store and to her job cleaning houses for other people. Her blue jeans were torn at the knee but yet she didn't complain or apologize. Very nice people.
Now, in comes David Syrcus:
David finds her after a long time, makes a trip up to SC to have her write a statement giving up any rights to money HE said didn't exist.
David was in this same trailor, saw the conditions, could see with his own eyes that this sweet woman could have used this money. But he makes the choice to continue with his plan to take advantage of her for his own gain. Where is his heart? Where is the honesty to do the right thing? And where is the ethics that a police chief is required to have in order to carry this badge that other chiefs and the general public hold in high regards. Are you seeing the problem here?
In comes FDLE:
They take a trip up to SC, they see the conditions, they have the evidence. Will they do the right thing? Do they see what David did to this woman? Do they have a heart? We'll see.
Were they trying to sweep this under the carpet when they informed him of the complaint and allowed him to file a counter complaint against the first party? The Florida Attorney General's Office sent the following response to an emailed request for an opinion regarding the compliance of this forum with Florida Sunshine Laws. While much of the information provided by the State concerns itself with online "meetings," I am hopeful that this forum will provide a means for informal communcation between Board Members where no decisions are made or votes taken.
One restriction mentioned is that public access terminals must be provided in order that the public can have access to the forums. Perhaps the terminals in the public libraries will satisfy this requirement?
At this time, the WAB has requested that the City Attorney provide whatever guidelines are required to make this forum compliant with the Florida Sunshine laws and accessible to the community. I remain commited to working the with the WAB, the City and the community to faciltating a better exchange of ideas and information. - Dave Bricker

COMMUNICATION--MUNICIPALITIES--anonymous newsletter used to communicate
among commissioners subject to Sunshine Law. s. 286.011, Fla. Stat.
Dear Chief Syrkus:
You ask whether a city commissioner who publishes an anonymous newsletter
using an e-mail address to receive feedback violates the Government in the
Sunshine Law when the newsletter is sent to and feedback is received from
fellow commissioners. You state that the commissioner uses the newsletter
to state his position on matters that will come before the commission and
solicits responses that are subsequently published.
Section 286.011(1), Florida Statutes, provides that "all meetings of any
board or commission of any state agency or authority or of any agency or
authority of any county, municipal corporation, or political subdivision .
. . at which official acts are to be taken are declared to be public
meetings open to the public at all times . . . ." The basic requirements
of the Government in the Sunshine Law are that meetings of a board or
commission be open to the public, reasonable notice of such meetings be
given, and minutes of the meeting be taken.
Florida courts repeatedly have stated that the entire decision making
process is subject to the Sunshine Law, and not just the formal assemblage
of a public body at which voting to ratify an official decision is carried
out. The statute extends to discussions and deliberations as well as to
formal action taken by a public body.[1] Therefore, the law is generally
applicable to any gathering where two or more members of a public board or
commission discuss some matter on which foreseeable action will be taken by
that board or commission.
As stated by the Supreme Court of Florida, however, the Sunshine Law is to
be construed "so as to frustrate all evasive devices."[2] The use of a
written report by one commissioner to inform other commissioners of a
subject which will be discussed at a public meeting is not violation of the
Sunshine Law, if prior to the meeting, there is no response or interaction
related to the report among the commissioners.[3] If, however, the report
is circulated among the board members for comments, with such comments
being provided to other members, there is an inappropriate interaction
among the members under the Sunshine Law.[4]
This office has found that the use of a computer by a board or commission
to communicate among themselves on issues pending before the board is
subject to the Sunshine Law.[5] Thus, the use of an electronic news letter
discussing matters that foreseeably may come before a board or commission
would be prohibited.
In this instance, the fact that the newsletter is anonymously written by
one of the commissioners does not alter the conclusions noted above. The
use of such an electronic newsletter facilitating communication among the
members of a public board or commission on matters that foreseeably may
come before the body for official action would be subject to the Government
in the Sunshine Law.
I trust these informal comments are of some assistance to you in resolving
this matter.

Here you go Melbourne Beach Resident. Case in point: The "Woodpecker" was a monthly news letter sent out by a person in MV. In it was information about the goings on in MV, good and bad. This little paper really got under david's skin because it made him look bad. How did David Syrkus find her? Used his position as chief to sepoena the AOL records to find out the person behind the email address. Sorry, Allegedly. The story is somewhere in this blog, I suggest you read the WHOLE BLOG. I just happened to go through all of your posts to see where your coming from with these last couple of posts of yours. Since you really do not contribute much if any. In one of your posts you asked why we hate Melbourne Beach. We don't, sorry your little town has THIS Chief. Don't blame us, blame the shotty backround check. You also made a half ass attempt on one of your posts to give David an excuse for what he did by saying "he cut his losses." What I didn't see, was your response to the other person who posted right after yours saying he did indeed receive a check for 65K. Want the check number? Therefore, it is my opinion that you are a friend of davids. You also wanted to know who we are by name. Why? I'm sure you don't want to get to know us since you don't like the way we play. Syrkus' charges have been forwarded to our State Attorny's office, we are asking that everyone write Norm's office and ask for the maximum punishment as Syrkus is a police chief and theoretically is held to a higher standard but broke the law anyway.
Now I am wondering about this here letter to the AG. It really is sad, This guy is facing felony allegations and he is trying to shift the focus onto something else. If i were him, I would be worried about more troubling issues such as: What goes with the Jail uniforms, and seeing the doctor to have my sphinchter surgically closed so bubba doesnt do too much damage. Actually it may not be too bad as if he does go to prision he will be among some of his son's friends and they will take care of him.

Mel, I have my facts straight! They have been laid out all over this blog but obviously you either haven't read them or can't remember what you've read. If your not David or his wife then why are you fighting against the FACTS so hard? Innocent until proven guilty, yes absolutly. However, the evidence is as such that a resonable person can see exactly what he's done. The evidence speaks for itself. You haven't seen the evidence so just sit tight and you'll see soon. He gets run out of one place and ends up in another until people get to know him and he has to move again. Read the story about the ex that he cheated out of thousands of dollars. The woman he screwed out of thousands of dollars would probably be pretty happy to have just a little bit of what David has, she paid for some of it.
