Town Clerk/ Police Chief Evaluations

I read that this Wed. The town clerk will get an evaluation. Let's discuss what we know about her performance. Let me hear the good, and the not good about her. Just make it factual, We will not post anything nasty or absurd. If there is a long enough list then perhaps at the meeting some people can stand up and ask the commisioners if they know what "negligent retention" means. If you want to get rid of her the best way is to gather the facts and present them and give them no choice but to see just how she is whether it is good or bad. If they are faced with the truth they have a duty to act because negligent retention is after all something the town can be sued for. Anyone with knowledge of town policies whether persoanlly or researched by public record is also welcome to contribute. Let's get to talking and again, keep it factual and clean. These posts will be screened closely and I will estimate that about 99% of anonomous posts WILL BE REJECTED. If you have knowledge of the chief in concert with her also please don't hold back. For those who dont know what that means, If you know of any scams we have not talked about with those two let it fly as well.

The town would look a little foolish if it took an employee who is being investigated for wrong doings off of probation. I say we wait until after all is said and done before we even think about it.

Just the fact that she was supported for the job by Davie makes you wonder and with him on his way out? I say extend the probation and send her and Davie home until their investigations are over.

The other blog is trying hard to get something going but having trouble attacking everyone and everything they are gaining more enemies than friends. It looks like this blog has information that matters!

Town Commission Special meeting tonight. 7 pm Come watch the circus in action. Before that a meeting where Commissioner Donnie Price will try to get the Town Commissioners to settle the lawsuit. More money in Mr. Price's pocket if he succeeds, he already admitted accepting $1,200 from the family suing us. that was all that was reported anyway. Wonder how much money has already changed hands? here is the reported only figures no one knows how much under the table action is taking place. $1,200 to Commissioner Price, $8,000 in campaign contributions to Bruce Black. A record for a small town campaign. In contrast Sandy Wilson spend about a $100.00 dollars on his town campaign last year. Sandy got elected Black did not? Guess Susan Dieterle can't fool enough of you. I guess Mr. Wilson refused to line his pockets with special money under the table rather than protect the town. Good for You Commissioner Wilson.
Now tonight the same Commissioners will decide if the Town Clerk stays or leaves. It is on the agenda to discuss evaluations. Watch and listen to what they say. You will get the picture quickly. I can't believe they are even considering her while she is under criminal investigation.
One more thing Mr. Walters if you decide to run again I will personally campaign for you door to door. I have a lot of support in the community and I have already called you with my offer so if you read these blogs you know who I am. Enough is enough! It is one thing to disagree but to try to totally destroy a person when they have done nothing to deserve it is wrong and I am saying so now! It looks like there is considerable evidence about the Chief though and I will be glad when the investigation is over and dean darling is vindicated. If not I will be cussing him like Susan does now. One more thing Susan I heard you said to Commissioner Price after the last meeting on December 21 "at least we ruined his christmas" refering to Mr. Walters. I say shame on you Ms. Dieterle! Truely you are not a creation of god.

In just two weeks sad sue and her band of plugs get cut off at the pass! No professional town manager would ever feed them and keep this going! This one is gone in just 9 days and the next will get the message real soon the chief must go. The false statments on his app. and the purchased degree are enough to say goodbye. Let alone an FDLE investigation. If the mayor continues kissing up to sad sue and Marty Smarty then he can go to! What a guy! Screw the people that helped your election to suck up to those who campaigned against you. Is anyone that dumb?

I wish we had control over the agenda but there is no way to find out. Well there is but I am not ponying up 300 bucks to Boss Hogg Burke's corruption fund. Now I have just stumbled upon something here friends and neighbors. We have a real life Hazzard county in Mel beach as long as these two backwoods yokals are in office. We have "Rosco P. Coltraine" running the local law enforcement aspect as crooked as a right angle. and low and behold "Boss Hogg" Burke skimming the public record money by charging outrageous fees to get records copied. The only thing that doesn't fit is lulu hogg as in this case rosco's "Fat Sister" is actually the wife. Hey to each his own I say. Anyhow I wish we could get an agenda but It would take some miracle, besides the clerk isnt gonna post an agenda for people to come comment on her piss poor performance. Theres my two cents, Ya'll come back now ya hear? (Yes I know wrong show but it sounds good darnit)

Just to show you how corrupt they are the other blog is now questionng who a council person can talk to after a public meeting? Do council people give up their right to speak when they take office? PLEASeeeeeeeeee is that all you can find to talk about. I saw several people hugging and shaking the hand of that same councilman after the meeting where were her spies then? Thought he had NO support? What a joke you people are. It does look like things are starting to fall apart for you sad sue. Did I hear right all three former city managers that supposedly quit because of Councilman Walters have now asked for their job back with him still on the council? only in melbourne beach can this happen people. The council need to start finding replacements for the chief and clerk and stop listening to sad sue and her plugs.

Way to go Ron Gallager! Finally some one had the courage and determination to speak up against these election losers. Bruce Black lost and if he runs again will lose again. He does not even own a home here. The losers need to understand the residents have elected a Mayor by a 2-1 margin. His name is William G. Stacey. Not Bruce Black! Do you get that, do you losers understand?

Go away Martha Remark, stop stiring up trouble. Same for you Ann Downing, Frank Thomas, and the fire department members like Jeff Stark sticking there noses in the town politics and asking for donations at the same time. How much do we pay them now? To much I bet.

You won't be picking our Town manager so stop trying!

Leave the Town alone. I am certain W.D. left for a lot of reasons and one of them I am sure is because he did not want to have to fire the police chief when the investigation is over. So butt out and let our elected officials alone!

it is never a good situation when one employee decides to bend the rules he/she follows within a job to HELP a fellow employee. when syrkus decided for whatever reason to not hire darling for a police position, good , bad, or indifferent; there was no reason for the manager to fire the same party from a job he had with the town. then the clerk adds insult by applying out of site prices for a copy of the chiefs file (which is about 80 per cent junk letters)

this is what causes law suits

now we all are aware of the lies that syrkus has told on this one citizen; crazy, portrayed a police officer, filed too many complaints,
hung with the wrong crowd, and took up too much time of the commissioners.

now we all know that it is syrkus and burke who fdle is looking at. the manager bailed and rightfully so. probably didn't want darling telling all that could be found about him.

this leaves the commission holding the bag. did they stop any of the employees bad behavior. NO, they sat back and did nothing. and who is now left with all the liability. the Town, the tax payers as usual. once the law suit is over and done the cost of next years liability will go up.

hopefully, the hiring practises in our town will get better. hopefully, we will have employees one day that really work for the town and not against the people that pay their salary. hopefully, we will be able to find real public servants.

and i say, the sooner, the better

MELBOURNE BEACH, Fla. -- A Brevard County police chief is dodging Channel 9's questions after Eyewitness News discovered he's the subject of a criminal investigation. The Florida Department of Law Enforcement is looking at a real estate deal involving Melbourne Beach Police Chief David Syrkus.

HEY HIGGINBOTHAM, have you not read the paper lately. Since when does a real manager let an employee continue to work when he is under investigation by FDLE. And you, David, haven't you always sent officers home when under criminal investigation?

Very well put Anonymous. I would like Ms. Burke to explain to us citizens why she felt the need to charge Dean Darling over 300.00 for Syrcus' file? Staples charges .15 to make a copy. For 196 pieces of paper, approx, it should have only cost 29.40. She can't charge for her time because she is paid by the city. Her time isn't worth that much anyway. Therefore, she gouged him pretty bad, out of spite! That's an abuse right there. Nice way to treat your TAXPAYING CITIZEN Patty! I wonder if this group of city "leaders" will take a look at this when they decide to "extend her probation?" She is clearly a liability to your little town. I say get rid of her. The way she does her job is a big question. She over charges for PUBLIC records, she can't notorize anything, she can't even show up for work on time and more often than not she leaves early, and she has issues with truthfulness so why are they keeping her? I'd say to Ms. Burke, find a job where the public won't be subjected to your petty spitefulness. Minnie Syrcus.

Copying a Police Officers files isn’t as simple as feeding a stack of paperwork into a copy machine, and handing a stack of copies across a counter. First the requested documents are copied, then Each and Every Page must be read by the clerk, and sensitive information didacted. There are State and Federal Privacy Laws that come into play, and the clerk must understand those laws, and apply them, obscuring information which cannot be released. Once the required information has been obscured on the copy, that copy is reproduced. The files Dean Darling requested had to be copied, carefully read by the clerk, didacted, and copied again. How long does it take YOU to carefully read 196 pages of text?

Extending a courtesy to a citizen, and copying a page or two of the town code for free doesn’t tie up too much of the clerks time. A demand for 196 pages of sensitive information which requires extensive special handling does NOT fall under the heading of “Extending a courtesy” As a Tax Paying Member of this community I resent the fact that Dean Darling seems to feel he has the right to tie up our town clerks valuable time, and that she should provide this service for free.

I read in the “Hometown wanna be” newspaper that Syrkus accepted an award for exceptional safety programs and standards. Just want to mention that it was for 2nd place. I wonder who was 1st and received $15,000 with another 5K to come next year. Hmmm who could it be, oh yeah, it is the Town of Melbourne Village. That’s gotta hurt. David, don’t pat yourself on the back, it wasn’t your efforts that won Mel Beach the award. When you were in Mel Village they didn’t even place, now that you’re gone they get first place. Wonder how that could have happened? Could it be, now that you’re gone the TMV is finally straightened out and on track? I think it’s rather interesting that yours and Higginbotham’s wanna be hometown news reporter friend didn’t even mention TMV’s accomplishment. Could that be because you two idiots need the good publicity because you’re drowning in the sludge you two created for yourself? Just wondering.

Whooo there cowboy. Dean Darling was fired for requesting public information but let us review what the manager alleged the firing was all about. W.D. said Mr. Darling was fired for creating a hostile work environment. w.d. put that in writing after confering with the police chief. Or so I am told. Wrong move for the town. They had the opportunity to do the right thing with Mr. Darling but they were so full of themselves and thier power they made the wrong decision. It has now come back to haunt them both. Look at W.d. Record with Gainsville and you have the answer. Lied about his education to get the job said he had a degree and then when caught said it was an clerical error? Sound Familiar Chief Syrcus? Why would anyone submit a resume with out first checking it over to make sure it was correct first? Why, because you could get the job base on a lie and your Bull Shi.then say it was a simple clerical error when caught. If you look at the resume you would know no experienced clerk wrote it. He wrote it and made it appear that he had a degree! Get the picture? no ethics at all. Just give me a job and later if you find out yuo can be embarassed for hiring me in the first place or ignore the error, your choice.

Then there was the $700.00 paid to put up three of W.D. secretaries on the beach for three days to get their reports done. What was that about? Gainesville is no where near the beach? Yet W.D. and another pal showed up at the ocean front room to help them get it done. You can see why Chief Syrcus has no fear. he has W.D. lieing about a degree, guglitta lieing about a degree and him lieing about a degree. No wonder they are such good friends.

I have a degree that I earned and it really pisses me off that these ignorant a-holes just say they have one and get jobs where people depend on them. Fire Syrcus, he's an embarrassment, a lier, and a crook. Kick Gugliettas ass off of the commission and when the other idiot, WD needs a referral for another job, Don't give it to him. By the way, was he cheating on his wife with one of the secretaries at the beach? Sounds like that's what was being implied above.

You have to make your own assumtions there but I found no direct allegations that there was play going on. You tell me why three sec.s get free room and board on the beach for three days at city expense. they had private offices in gainsville city hall when this happended but were moved to the beach.

But there was another incident in south florida only one surving council person would talk about. that really raised eyebrows to the extent even the press couldn't get a comment from a council person. . This was more than 18 years ago but it does look like lack of integrity.

Who was the idiot talking about copying police files? There are only a few things confidential by law when it comes to a cops personel file. Social security address and such. If the dumb asses running the show would put that paperwork in a seperate file then it is as simple as dumbing everything else into the copier and BLAM you have copies in minutes rather than days. The confidential info stuff should be redacted and then copies made of the remainder of the page and placed in the file that can be copied. Again BLAM the whole file ready to copy at a moments notice, done in a few miutes. Sitting there going over each page every time some one wants a copy of a personel file shows you just how incompetent they really are. Better yet goof balls try scanning everything into your computer and putting it on CD minus the confidential stuff and you can just hand it to them 10 seconds after they arrive. DUH! Thought Chief Syrcus was a visionary when it came to tecno advances. charging $300 bucks is criminal.

The fire deparmtent is volunteer but they get a few dollars for training. Cost about $15,000 dollars a fire call in town. plus they keep thier donations and I heard they spend about $25,000 on food each year for the 25 members.

the fire budget is around $250,000 so it ain't free. They should put both police and fire togeather and save us money.

Slow Down There Am-fixing-it, you state “There would be no reason for the clerk to read those letters.” The truth is, Both State and Federal Laws require her to read every page to ensure that they contain no sensitive information. The only way to determine whether or not a page contains sensitive information is to read it.

In most government offices there is a charge for any document copied by office staff.

No one is complaining about paying 15 cents per page for copying even though it costs about 2 cents. The labor is already built into the price cities charge. The problem is arbitrary addition of labor costs for clerical assistance when no such assistance is needed or even used. Why should I pay for a slowwwwwwwww town clerk like Ms. Burk to find records that should be available in minutes. Why should I pay more "taxes" because she isn't efficient. One commissioner told me there is no reason to charge for labor 99 out of a 100 requests. He said on occasion lawyers suing or builders building require extra services and are then charged for labor costs. We already pay her $50,000 and what do we get? More charges and sorry she isn't here today, sorry she isn't here right now, sorry she took the day off, sorry she went on vacation, sorry she isn't back from lunch yet. What ever happened to 8 am to 5 pm. Does she ever get to work on time? Why does she bring her children with her?

Dean Darling gets charged for labor even before Ms. Burke checks to see how many records he will need? She requires a $175.00 deposit before checking? Ms. Burk is placing obstacles to getting public records and it is wrong and illegal. All they are doing is making a list and checking it twice before handing it to the State Attorney and florida today, both are advocates of the freedom of records law. MB will have more problems trying to justify the record they are now creating one obstacle at a time.

lesson 1 for Pat Burk:

It is the policy of this state that all state, county, and municipal records are open for personal inspection and copying by any person. Providing access to public records is a duty of each agency.

(2)(a) Automation of public records must not erode the right of access to those records. As each agency increases its use of and dependence on electronic recordkeeping, each agency must provide reasonable public access to records electronically maintained and must ensure that exempt or confidential records are not disclosed except as otherwise permitted by law.

(b) When designing or acquiring an electronic recordkeeping system, an agency must consider whether such system is capable of providing data in some common format such as, but not limited to, the American Standard Code for Information Interchange.

(c) An agency may not enter into a contract for the creation or maintenance of a public records database if that contract impairs the ability of the public to inspect or copy the public records of the agency, including public records that are on-line or stored in an electronic recordkeeping system used by the agency.

(d) Subject to the restrictions of copyright and trade secret laws and public records exemptions, agency use of proprietary software must not diminish the right of the public to inspect and copy a public record.

(e) Providing access to public records by remote electronic means is an additional method of access that agencies should strive to provide to the extent feasible. If an agency provides access to public records by remote electronic means, such access should be provided in the most cost-effective and efficient manner available to the agency providing the information.

(f) Each agency that maintains a public record in an electronic recordkeeping system shall provide to any person, pursuant to this chapter, a copy of any public record in that system which is not exempted by law from public disclosure. An agency must provide a copy of the record in the medium requested if the agency maintains the record in that medium, and the agency may charge a fee in accordance with this chapter. For the purpose of satisfying a public records request, the fee to be charged by an agency if it elects to provide a copy of a public record in a medium not routinely used by the agency, or if it elects to compile information not routinely developed or maintained by the agency or that requires a substantial amount of manipulation or programming, must be in accordance with s. 119.07(4).

During a week in January, the Herald-Tribune and 29 other Florida newspapers tested how officials responded to a routine request to inspect records. Reporters and other news media employees posing as citizens visited 234 local agencies in 62 of Florida's 67 counties.
Overall, 57 percent of the agencies audited complied with the public records law. The rest made unlawful demands or simply refused to turn over the records.
One volunteer was almost arrested.

Many officials demanded to know who the volunteers represented and what they planned to do with the information -- clear violations of the open records law, which ensures anonymity when desired.
"Basically, it's not the government's business why a member of the public wants a record," said Pat Gleason, general counsel for the state's attorney general. "The desire of government to impose procedural roadblocks … directly conflicts with a citizen's right of access."

For a state that prides itself on being a leader in open government, the results are disappointing, said state Attorney General Charlie Crist.

Since 1909, Florida law has guaranteed its citizens access to public records. In 1993, the right was written into the Florida Constitution, one of only a handful of states to adopt such a powerful protection for citizens.

Today's law says the public can inspect any document generated by the government, unless it carries a specific statutory exemption. That includes written communications, investigation results, financial records and personnel files.
The audit volunteers asked for documents that should have been easy for officials to retrieve: 911 call logs from sheriff's offices, city manager job reviews, county administrator e-mails and school superintendent cell phone bills.

The best results came from city managers, who complied 68 percent of the time.

The ability to inspect government records lets the public police the officials they bankroll with tax dollars.

"The law clearly says that public agencies cannot institute any kind of requirements that inhibit access, or chill this right of access, including requiring people to give their names," Chance said. "Sometimes I think bureaucrats forget that the purpose underlying all of this information is to serve the taxpayers."

Training is readily available from a variety of organizations, including the First Amendment Foundation. The state attorney general offers training sessions and produces public records guides for law enforcement officials and other government agencies.
The state requires newly elected officials to sit through open-records training when they take office. But there is spotty training among clerks, receptionists and secretaries who greet members of the public when they walk into government buildings.

Crist said the state may need to consider providing more training for government employees and perhaps requiring it, an idea backed by public records advocates including the First Amendment Foundation and the Brechner Center.

To the retired chief, I'll play your little game. You don't sound very educated to me. You sound like one of the Syrkus Freaks. Answer these question for me. Why, when one citizen of Melbourne Beach requested public records was he charged the outragous fee of 355.00? Could you look it up in one of your text books to see if there is a cap on the fees that can be charged for PUBLIC RECORDS that were not archived or stored in any special place besides a filing cabinet within city hall? And is there a law against notorizing important documents to help someone defraud another out of thousands of dollars? Also, is there a law against notorizing a faxed document whereas the "signee" is on the other end of the fax? One more, when davie received his divorce decree at what point did the badge get so big that he didn't have to obey the JUDGES orders? How about answering these questions instead of acting like an idiot by insulting others.

I would like to address Dean Darling;

I would like to know why you would want to even consider a career in Law Enforcement. I don't see this field as one for you because you are an honest person and won't back down from a fight when you find an injustice committed against others. Don't get me wrong all of you law enforcement people, I'm not saying you’re ALL crooked however I don't see the honest ones coming to his defense and offering him a position with your departments. I think that's called "black balling." You are black balling this guy because of something a CROOKED CHIEF did! Nice testimonial to the profession! Dean, are you seeing what has happened thus far? You went up against a CROOKED CHIEF, A VERY DISHONEST CLERK, and what has it helped except get FDLE off of their butts and finally investigate these people. I applaud you for that. You have been criticized repeatedly by your fellow citizens and their narrow minded friends, slandered by this CROOKED CHIEF, totally overcharged for records you have every right to ask for by this VERY DISHONEST CLERK. I urge you to think about wanting to be in this career. I will personally attempt to get a hold of you so that I can offer you a position with my company which, I promise you, you will make more money than any of these clowns who call themselves, “protecting and serving” us here in Melbourne Beach. Anyone care to comment on DIETERLE'S ,GUELIETTA AND SYRCUS attempts to control who gets chosen Interim Town Manager?

Some of you have received calls and phone messages. Dieterle EVEN ATTEMPTED TO HAVE THE MAYOR'S PHONE MESSAGES SEIZED!

Some of you have received written information and others written instructions on how to control the meeting so the Mayor can't.

It appears that some of Dieterle tactics are pretty nasty and Some of it is pretty complicit with Marty Smarty and others but then what would you expect from sad sue. Will our volunteers arrive in mass again so a minority can decide for the majority?

Let us all know how they will try to push ciumo through BEFORE the meeting so we know what to expect if we attend.

Will they choose an interim manager tomorrow or do you think they should spend some time checking references and decidng salaries and benefits after conclusion of all interviews, before an offer is made? WHO will push to hire tomorrow night so to allow the candidate to determine their salary after the fact?

WHO will push for a vote as soon as the interviews are finished and before anyone has time to think and review what all of the candidates have stated there positons are and what they can accomplish?

How about that. You work for me. I pay your benefits, I pay your salary and you are extending me a courtesy? I say you are doing what you are paid to do! This seems to be the problem with burk and syrcus they think we work for them. The clerk has 8 hours a day to do her job which is to provide records. 196 pages of sensitive material which require extensive handling my butt. darling didn't ask for a genetic code, he asked for a copy of a personnel file! Anyone that believes this dribble I have a causeway for sell on 192. You can set up a toll and make a fortune.

Dean Darling was never an employee of the Town of Melbourne Beach any more than Joe the grass cutter, or who ever that is cutting the grass. Independent contractor have no claim on the Town except for the work they have done and expect to get paid for. Such contractor serve are the pleasure of the Town Commission or manager and their service can be terminated at any time the Commission or manager sees fit.....they are not employees sio get your facts straight. Get the facts before you put your foot in your mouth.

They already have paul guglittea. and Price in their pocket. I hear there will be an attempt to remove this trouble maker from town boards soon. She causes so much hate in the town.

To all the town Comm. if you are reading here. Pick someone that will stop this controversy and will serve the town not some one that will keep it going.

Commissioner walthers has already sold 192 causeway to Susan Dieterle. She hired Bruce Black to be the toll taker and offer hot dogs for a buck. No mustard or ketchup! Black doesn't want the money he takes in to be tainted this time.

even volunteers can be told their services are no longer needed. they don't have to have a reason. DD probably insisted on a reason, so that is what he was supposedly doing so that is what he was told.

It was a stupid management mistake to fire a contract worker for asking for public records.

He will not sue for the firing he will sue the town for harrasment to him and say it was another attempt to prevent him from getting public records he had a right to.

Smart chief you got there. I hear he confronted his clerk and passing along some information. She got upset and resigned. The chief let her go on vacation and then let her back to work in the office. If he couldn't trust her then, why in the hell did he let her come back after her vacation? Not too bright bubba. She stabbed you in the back once and you let her back to do it again. Don't learn too quick do ya bubba?

what is the clerks name. Is this the one that had the boy friend policeman sleeping on duty and the Chief ignored the danger to us but the Lt. got upset so they let the policeman quit and got him a job in fellsmere?
