I have been told of some recent media coverage on a local rag. Anyone care to comment?

Hey "PROBATION PAT" another 6 months! What the hell do you think your lawyer is going to do for you? The city was well within their right to extend your probation. Look at your record! Are you thick? Your a screw up and you should have been fired so just be glad you get to suck a few more paychecks out of Melbourne Beach. It was pretty funny how they made you wait until the very end to let know. Man, that must been torture. What happened David Jyrkus couldn't help you with this? You helped him steal thousands of dollars from his ex and this is how he repays. Bummer!

In about 2 1/2 weeks I hear. Things got a little behind due to the holidays. I for one can't wait. We'll get a crook off the streets and out of a position of authority where he can and has done a lot of damage. I would love to be there when they put the cuffs on David & hopefully Ms. Burke.

Check the other blog. first SAD sue said it wasn't her blog, now she thanks Mr. Twigg for posting his real name and asks others to do the same, then she replies to her own posting saying she posted her name and is being harassed? She spends a lot of time on defining our english language for us. What next from this weirdo wacko? When the report from FDLE is out watch her try to spin it if anyone is still reading her babble.

You called that one right. Yes all were there including former disgraced mayors that don't live in Mel Bch and their relatives that don't, fire department volunteers that don't live in Mel Bch, and failed city managers and former council members. I heard they were called and asked to attend. Paul Gug. and Susan Dieterle called them so they could stuff an interim up the council's noses before they had time to blow. They think the Mayor can be munipulated and planned a public attack on him. Didn't work out when Clerk Buke finally got around to saying more people had applied. Don't even think that big crowd was there by accident. The same people proclaim Walters is destroying the Town but they are trying to hire a city manager fired from the town twice? I heard that will make channel 9 news as they heard the sad story in 2001 when she was at her finest and on the way out. Can't wait to see them on TV studdering. Time to call Josh again. Now a few idiots are calling the council trying to push her in the door with the lie she only wants the job as interim? Ciumo is obviously past 65 and this is her last stop. We don't need another retiree on the payroll. Just got rid of one. She only wants to help the Town hire the full time manager but just might consider it herself? Funny. Why would the council want her to help hire anyone? She was fired in Mel Bch and can't keep a city manager job herself! Paul Gug. keeps pushing and wants a pal to replace the one he lost. What a game they all play. I heard the police chief even showed up on a Saturday just to see if he could give his pals Downey or Ciumo some help. But it looks like no one wants to be to close to him at the moment and his credibility is way past zero.

I read the rants and raves on "the blah blog" and there was a so-called ex cheif on the other blog posting under "anonymous" of course. He mentioned that he did some research on chief Jyrcus and said he was well respected and then went on to reduce our size to a small group. This is what I mean by idiots! First of all there is no way this idiot can be or ever was a chief therefore leading me to believe that Sad Sue realizes that no one is listening to her anymore so now she is making crap up. If it is a real chief then he again is an idiot which is why he isn't a chief anymore.
Now, idiot on the other blog, you have no idea about the law or how to even read, did you lie about your BS degree as well? Did you steal thousands of dollars from your ex wife? Did you make a total ass out of yourself by screwing people out of carreers because they disagreed with you? Did you lie over and over to the citizens you were entrusted to uphold the law for? Did you committ felonies or shoot up a building? One last question "idiot" Do you have more than a 6th grade education? Learn how to do research because this loser you just defended is NOT WELL RESPECTED at all!

I guess I need to say this again. Burk will resign or be let go after the investigation shows she did notarize signatures with out the person present and that is criminal. I doubt the council wants anyone on board that would use there notary that way. Sinc ein the future they would be responsible for her. Syrcus will try to stay on till the bitter end but will be fired.

Now listen UP this time people. This means you D.C. I know what I am talking about here. If there is any truth there is some complaint being charged against Walters who ever made it will lose! He will win. He is way to smart to let some stumble bums nail him. It just won't happen friends. I watched this guy on near a daily basis for years and he is one careful dude. He is the cheapest man I know with city money but honest to a fault. I watched him refuse time and time again to bend a rule even just a little. He would spend his own money of stuff for PD and officers then just say it was donated. I would bet anyone nothing will stick!

I don't call him a friend but I do know what kind a person he is and he just wouldn't do anything un ethical or illegal.

I heard Paul G. and the toad are involved some how and if that is all he has to worry about I am laughing my head off now.

Why didn't your campaign flyers mention Bradford?

Work with, and listen to all citizens?

Work with other Commissioners?

I want to serve you as commissioner?

The petty politics, special interests, friction, and other misconceptions that have plagued our town and its administration and civil servants in the past must stop?

It is the responsibility of our elected officials to ensure that our town runs smoothly every day and that "ALL" citizens and town employees are treated fairly?

Our elected leaders should set the example and standards for everyone in the administration to work together and in harmony for the good of the citizens?

I promise all of you, hard work; fairness; HONESTY?

Walters,if you think it was illegal, why not step up to the plate and ask the town manager about what you call an illegal transfer. What I've heard about him...he'll be happy to give you the FACTS..if FACTS are what you want..not hearsay or your version But then again FACTS make for dull press and you've never been one to let the truth get in your way of fiction. But then again..if you don't trust the town manager, why town don't you ask the independent auditors that the town employs. But wait...maybe they too participated in wht you claim to be an "illegal transfer".

that's a real interesting word "CHIEF"

syrkus used to have it plastered across the front of his unmarked squad car; up until he got several complaints filed with the Melbourne Police Department. It seems he continued to stop at the same 7 Eleven store for beer, wine and condoms. the store employees had a problem with his opening the beer, pouring it into a cup and driving away. the store was in Melborne and the employees kept calling the MPD. Melbourne goes out and retrives the inhouse security tapes and there's fatso. a report is made out and Melbourne delivers it to Mayor Rob Downey, syrkus's so called boss. Robbie doesn't want his champion to get in any trouble so he takes the tape and the report home with him (another idiot to public record) where it stays until the clerk hears about it and explains that he has to bring it to the town office.

it wasn't long after this incident that syrkus removed the "CHIEF" plate from the front of the car and even went to a regular lisence plate instead of the yellow county one.

guess he NEEDED the camouflage

Now you say I am uneducated and that you teach criminal justice at the University? Well then, I was probably one of your students therefore if I am uneducated then you didn't do a very good job now, did you? Did you purchase your Master's Degree? Further, if you would like to post on this blog then feel free. You say,"I do know how to research and can prove what I say as facts," then prove it, where waiting. We have already presented our evidence which lead to the FDLE opening an investigation on Syrkus. Now I ask you, just how is that playing God? You say I find people guilty based solely on my opinion, are you for real? The evidence speaks for itself, I didn't make the evidence up. Do you even know what the hell is going on? You say your "old" I guess so. Your obviously without all of your faculties. Your little threat doesn't scare me, it's you that doesn't know who you are messing with. Last spring I began a lengthy research project about the effect(s), if any, of the internet on small town politics. Mel Beach is a natural as I used to live there and it had a good web site and lots of controversy. The blogs have really added to the mix!..I check four every day. Are there others?
Anyway...I need the minutes of all the meetings...agendas would be nice too, but the premise of my paper is that this info would be available to all citizens. I've recently been made aware that controversy surrounds the town clerk and that she, apparently, is resposible for the web site I rely on. I need the missing minutes from August, September, October and November. As citizens do you also expect the minutes of "special" meetings? That would be nice. Can citizen pressure cause these documents to appear on the town site? I can't use them unless I can prove they are available to all. I queried the town once...with no answer...but my advisor told me not to do it again. Only resident voter actions count. You bloggers are my last resort. Question...can citizen pressure generated from the internet produce tangible results?

(1) A confidential registration certificate and registration license plate or decal shall be issued under a fictitious name only for a motor vehicle or vessel owned or operated by a law enforcement agency of state, county, municipal, or federal government, the Attorney General's Medicaid Fraud Control Unit, or any state public defender's office. The requesting agency shall file a written application with the department on forms furnished by the department, which includes a statement that the license plate or decal will be used for the Attorney General's Medicaid Fraud Control Unit or law enforcement or any state public defender's office activities requiring concealment of publicly leased or owned motor vehicles or vessels and a statement of the position classifications of the individuals who are authorized to use the license plate or decal. The department may modify its records to reflect the fictitious identity of the owner or lessee until such time as the license plate or decal and registration certificate are surrendered to it.

(2) Except as provided in subsection (1), any motor vehicle owned or exclusively operated by the state or any county, municipality, or other governmental entity must at all times display a license plate of the type prescribed in s. 320.0655. I wonder why he and sad sue are causing so many problems? Wonder why he promised to "work togeather in harmony for the good of the residents" then voted to allow personal attacks on another council person. wonder why after saying he would set the example he read a private letter written by a council person critical of the manager to a room full people knowing it would embarss all involved and create even more controversy? Isn't Mr. Darling a citizen. shouldn't he have been treated fairly?

Don't worry Dick Tracey about Poor Paul he has 10 months left in office. When every voter has a copy of his discharge papers and campaign papers they will say it all. Number 214 is in upper corner? No what that is Poor Paul. Remember he claimed on his campaign flyers he has 35 metals for valor was wounded 2 times in combat, silver star and even elite ranger parachutist. THE PUBLIC RECORDS LAW
Chapter 119, F.S.
Every person who has custody of a public record must allow the record to be inspected and examined by any person desiring to, under reasonable conditions. The custodian must furnish a copy of the record upon payment of the cost of duplication or of the fee prescribed by law.



APPLICATION
What materials are public records? "Public records" include: all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of physical form, characteristics, or means of transmission, made or received pursuant to law or in connection with the transaction of business by any agency. The only exceptions are for records specifically made confidential by the Florida Constitution and records exempted by state statute.
What agencies are subject to the Public Records Law? "Agency" includes any state or local officer, department, division, board, bureau, commission, or other unit of government created or established by law and any other public or private agency, person, or business acting on behalf of a public agency. Records of advisory boards created by governmental entities to provide advice or make recommendations are subject to the Public Records Law.



REQUIREMENTS
May an agency refuse a request because the agency believes disclosure could violate privacy rights? No. Neither the custodian of records nor the person who is the subject of a record can claim a right of privacy as a bar to inspection of a public record without a specific statutory exemption.
May an agency impose a waiting period or establish a specific time period for access to public records? No. The only delay permitted in producing records is the reasonable amount of time it takes to retrieve the record and delete any exempt portions.
May an agency require that a request for records be made in writing or that the requester furnish background information? No. A custodian must honor a request for copies of records whether the request is in writing, over the telephone, or in person, as long as the required fees are paid. A requester cannot be required to disclose his/her name, address, or telephone number unless this information is required by law. If a public agency believes it is necessary to document a request for public records, the agency may require the custodian to complete the appropriate document.
Must a person give a reason for his/her request? No. The Public Records Law does not require a person to show a purpose or "special interest" as a condition of access to public records.
May an agency refuse to allow inspection or copying of public records on the grounds that the request is "overbroad"? No. A custodian is not authorized to deny a request for access to public records because it is not specific enough. If a request is insufficient to identify the records, the agency has the duty to notify the requester promptly that more information is needed. Unless there is a statutory exemption, a custodian must produce the records requested regardless of the number of documents involved or any inconvenience. The agency is authorized, however, to charge a reasonable fee, in addition to the actual cost of duplication, for the cost of extensive use of technology resources or personnel if required by the nature or volume of the request.
May an agency refuse a request because the record requested contains exempt information? No. If a record contains information which is exempt from public disclosure, the custodian must delete that which is exempt and provide a copy of the remainder. Also, if so requested, a custodian must state in writing the statutory citation authorizing the deletion.
Is an agency required to answer questions regarding contents of public records? No. The Public Records Law does not require an employee to answer questions regarding details of the contents of records or to excerpt or interpret them for the public. However, an agency must respond to all requests for any information about copying costs.
Is an agency required to produce records in a particular form? An agency is not ordinarily required to produce records in a particular form. For example, if the health department keeps a chronological list of dogbites involving rabies, a requester cannot require the department to reorganize the information by geographic area. However, an agency is required to provide a copy of a public record in any medium maintained by the agency.
Is an agency required to comply with a request for records stored in a computer? Yes. Information stored in a computer is as much a public record as written pages in a book or file folders, and are governed by the same rules as other public records. An agency that maintains a public record in an electronic recordkeeping system must provide a copy of a requested record in the medium requested if the agency maintains the record in that medium.
May an agency refuse a request to inspect or copy the agency's records on the grounds that they are not in its possession? No. An agency is not authorized to refuse to allow inspection of its public records on the grounds that the documents are in the actual possession of someone else (such as the agency's lawyer). Public records may not be removed from the place where they are ordinarily expected to be kept, except for reasonable business purposes.
May an agency charge a fee for the mere inspection of public records? No. Public records must be open for public inspection without charge unless otherwise expressly provided by law. But if the volume of records to be inspected is large, requiring the extensive use of agency resources, a special service charge could be applied. (See below). It is irrelevant whether the requested public record is a written document, a videotape, or information stored in a computer. Providing access is a statutory duty of all records custodians. It is not a revenue-generating operation.
What fees may be charged for copies of public records? Agencies are permitted to provide copies of public records without charge. An agency may, however, charge for copies, as long as the fee does not exceed that established by law. If no other fee is set in the statutes, the custodian may charge up to 15 cents per onesided page for paper copies that are 8 1/2 by 14 inches, or smaller, and no more than 20 cents for twosided duplicated copies. Up to $1.00 per page may be charged for certified copies. For other copies, the charge is limited to the actual cost of duplication. The phrase "actual cost of duplication" is defined to mean "the cost of the materials and supplies used to duplicate the record, but it does not include the labor and overhead cost . . . ." No fees designed to recoup the original cost of developing or producing the records may be charged. An agency may also charge a reasonable fee, based on actual costs incurred, for the extensive use of agency resources.
How long must an agency retain a public record? Whoever has custody of public records must give them to his/her successor at the expiration of his/her term or, if there is no successor, to the records and information management program of the Division of Library and Information Services of the Department of State. Florida law requires agencies to give the Division a list or schedule of records that are no longer needed in the transaction of business and that do not have enough administrative, legal, fiscal, or historic significance to justify keeping them. The Division has rules, binding all agencies, concerning the disposal of public records.



PENALTIES
What are the options if an agency refuses to produce public records? Mediation. For more information about the voluntary Public Records Mediation Program, please contact the Office of the Attorney General. Civil action. Any person denied the right to inspect and/or copy public records may file a civil action in circuit court against an agency to compel compliance with the Public Records Law. These actions are entitled to an immediate hearing and take priority over other cases. A public agency's unjustified delay in complying with a request until after litigation is filed amounts to an "unlawful refusal." While an action is pending, the custodian may not transfer custody, alter, or dispose of the record. If a civil action is filed against an agency and the court determines the agency unlawfully refused to permit a public record to be inspected, examined, or copied, the court shall order the agency responsible to pay the costs of enforcing the law, including reasonable attorney's fees and court costs. Attorney's fee are recoverable even if access is denied on the mistaken belief that the requested records are exempt from disclosure. Criminal penalties. A public officer who knowingly violates the Public Records Law is guilty of a misdemeanor of the first degree, punishable by penalties of up to one year in prison, a $1,000 fine, or both, and is subject to suspension and removal. A violation is also a noncriminal infraction, punishable by a fine not exceeding $500.

Well, Givemeahome finally someone is willing to comment without being rude and obnoxious and calling people names although the name of your planet is a bit sarcastic. I still believe that a person is innocent until proven guilty regardless if this person is a police chief, an elected official or any other public official. Sometimes evidence is not always as it seems regardless of what you personally believe.

I believe the Town of Melbourne Beach has a lot of problems and those problems are more than a police chief, a town clerk or a commissioner. I don’t believe it is right to hide behind made up names even though I am as guilty as the rest of the bloggers. I am a believer in our criminal justice system and believe that in time the truth will come out but until then we still must have faith and believe in the people we entrust to run and protect our towns.

I hope we can agree to disagree and I hope we can agree that all people regardless of if they are public officials or not are innocent until proven guilty.

If you want to make an effort to improve government do it in a positive way, constant trashing of public officials is not the answer. I have not really commented on the commissioner because I have not had the time to research his background. The items on the Melbeach32951 site appear to be damaging. But then again one is innocent till proven guilty. If only the efforts of both sites would be spent making Melbourne Beach a better place to live and not trashing people so much more can be accomplished. Well, I’ll get off my soap box now. I will attempt to post this to both sites as maybe it will penetrate some of the bloggers minds.

You said that you had been reading both blogs for a couple of weeks now. Sounds like you have a little extra time on your hands. Ever thought about coming out of retirement? Word has it, Mel Beach will have an open position reeeaaallll soon. Your education sounds like you are way ahead of the present chief unless yours is store bought too.

And whose job would it have been to find out exactly what was happening and then take appropriate action when channel 9 broadcast a TV news program indicating the police chief was under FELONY investigation?

anonymous get real! W.D. should wait until he is officially NOTIFiED BEFORE THE PLACE COMES TUMBLING DOWN? Where is that written in any management book? Watch the news and instantly know you have a major problem brewing but wait until an excutive officer is arrested before
acting?

The ink isn't dry yet but the "town is a cesspool of terrorists" sad sue, has already spent her entire morning challenging every single word Comm. Walters wrote in Florida Today. Didn't she say it wasn't her blog? Or did she just change owners and continue to write for them? HMMMM was that why it was down a couple of days?

Wait for the FDLE report on Chief Syrcus. She will turn that into a novel. I believe it will be more of a short story but you know how her mouth runs on and on.

Slow down there old girl and relax a little. I told you this guy is slick but you aren't listening.

Put something out again and he will stick it to you again. That is just the way he is. he has a very long memory as I recall to my regret on more than one occasion.

If you are reading the 3rd blog devoted to sad sue who they claim is a public official it is no wonder she is getting cranky about now. 3,755 hits to date with about 30 bloggers, all supporters from the read.

MOOREFIXIT... I apologize if we missed one of the posts. This blog (as written in latest post) is trying to bring the misconduct/violations of law committed by David Syrkus. Nobody should be negative towards other bloggers and we try to catch them but we have SOO many posts to read sometimes we miss some of them. We do allow Anonymous posts sometimes because some people do not have the intelligence to register! There are only 2 of us for now and we have a hard time sometimes with the DOWNRIGHT NASTY posts that we let one or 2 get past us for this I apologize. EVERYONE is more than welcome to post comments on here as long as they follow the rules. We will accept conversation the relates to the current topic.. We just dont want people to lose sight of the real reason for this BLOG---Bringing the truth out. If ANYONE has an idea for a post on the blog let me know and I will consider it. You are more than welcome to post on here ANYONE... HOWEVER, the MAIN person I would like to hear from is DAVID... I would like him to answer to the CITIZENS that he works for. HE is responsible for his actions and he is supposed to be a representative of the MELBOURNE BEACH POLICE DEPARTMENT... I dont think he does that very good. He is embarrassing the NICE CITY OF MELBOURNE BEACH and ALL of the residents.

I sure hope some one was giving us a story here. No way a police chief would file a complaint saying A citizen committed a crime
when they didn't just because the citizen called his x-wife.

If you did file a complaint let me say now.

COME ON DOWN DEAN DARLING AND PICK UP YOUR INSURANCE SETTLEMENT.

Chief cut us taxpayers a little slack here will you.

Anonymous, Jurkus certainly did file that complaint! Did you read where, when he went up to SC to TRY to cover his ass, he told his ex and her husband that DD was crazy and he may come up there to try to harm them? It's in her statement. He even put Dean Darlings picture on their refrigerator! You gotta love the dramatics there! That was his hook to get in the door to get the bogus statement written and signed. I am telling you; syrkus is nuts! I would warn the good citizens of Melbch to run for cover when FDLE shows up just incase he sees fit to shoot up your department. Been done before down south. I know FDLE knows about this so they'll probably have him meet them some place away from innocent people. We hope.

Hey all, the "other blog" is upset that WD's going away luncheon only drew a crowd of 11 and their pissed. One question, did Sad sue make the food? They are probably going to push to have a statue erected in his honor. Sad Sue wants everyone to post any parting comments for WD if you have one. Ok here is mine, GOODRIDDEN’S SORRY ONLY 11 PEOPLE SHOWED UP AT YOUR GOING AWAY THING. MORE FOOD FOR DAVID! WD, WHY DID YOU TRANSFERR THAT MONEY, 60 SOMETHING K? Chief Syrkus should be a man of his word. He said it and I have no reason not to believe him. When I read a quote from yesterday in hometowns news I decided to take him at his word that "everything was done legally and appropriately"
when he sold his house and his wife was never cheated.

I know what legally means and I know what appropriately means!


If the FDLE report says anything and I mean anything to the contrary Chief Syrkus I will be looking to have you FIRED!

Hello Anonymous, I think that I am one of the few that have actually seen and felt the evidence this crowd has collected against our Syrkus. I too was willing to give him the benefit of the doubt before I actually saw the docs. I will tell you, what he did to this woman he will burn in hell for. I wish our spineless counsel members had fired that witch Burke, why do you suppose they extended her probation. I saw what I saw and she broke the law along with David Syrkus. I think I was told next week or the early part of the following is when FDLE will be finished and the state Attorney will then have it to file the charges. You'll see.

I heard the former city manager W.D. tried to blame the non existing Hamilton college for Syrkus buying his fake degree?

That is really really funny. Chief Syrkus buys a degree from a university that does not exist. that offers no classes, and is nothing more than an old closed motel. He writes a four page paper and pays about $2,000 and they mail him a worthless piece of paper that he uses to fool a local selection board which includes several police chiefs, members of the city civil service board, and even police employees


An added touch by Hamilton college was to issue a fake college transcript listing classes chief Syrkus completed along with the amount of credits he earned.

All of this was designed for the sole purpose of fooling potential employers into thinking you have a legitimate college degree when all you did was buy a piece of paper.

Most intelligent people know that it takes years to earn a college degree. Buy it with a 4 page paper and Chief Syrcus had to know it was not a college but a dipolma mill.

Once he is on a list of police chief eligibles, that were selected finalists by the board he is interviewed and given the job after making sure the former police chief recommended him to W.D. and all involved.

when a complaint is filed by a city resident alleging violations such as submitting false applicaton for employment and fraud against the Town the former city manager does not order an investigation but writes a letter to the person complaining telling him to complain to the non existent hamilton college.

Stop here and think about three personality traits a police chief must have in our opinion in order to effectively manage a police department integrity, honesty, and good character.

How can he manage now when every police officer on the force knows what type of a man he really is? They may not say anything but they know him well and will never respect him. I know a couple that think him a disgrace to the uniform. I guess the police chiefs that recommended him feel betrayed to.

How will he ever be able to maintain discipline when he is so tainted by this lack of judgment?

Throw in his terrible 20 year record as a police officer in numerous other police departments, now local fodder and talked about at local dinner parties, and you have a disaster for the city.

add to all of this the current fdle investigation where you have a city clerk notarizing forged signatures and I see hard times for the city in the near future.

Wow! I totally agree with the last anonymous post about Donnie Price selling the town out for 1200 bucks. I tried to post that on the other blog, but it didn't make the cut, I'm afraid.
